PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR USING THIS PROGRAMME, YOU AGREE TO BE BOUND BY THE TERMS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU SHOULD NOT PARTICIPATE IN THIS PROGRAMME.

Terms & Conditions.

Kings Heath Pet Centre Loyalty Card is the loyalty card scheme that rewards the members with 100 points for every £1 spend and exclusive benefits when they shop in our store. 100 points is worth 4 pence towards future purchases in store.

1. Introduction

1.1 These terms and conditions (the ‘Conditions’) set out the terms on which you can join the Kings Heath Pet Centre Loyalty Card Scheme. They are also the terms on which Kings Heath Pet Centre can use your personal information.

1.2 If you apply to join Kings Heath Pet Centre Loyalty Card or use a Kings Heath Pet Centre Loyalty Card you automatically accept these Conditions.

2 Joining Kings Heath Pet Centre Loyalty Card And Using Your Card

2.1 Your name and full postal address must be provided for a Card to be registered. Applicants must be aged 16 or over and must have a resident UK, Channel Island or Isle of Man address. Kings Heath Pet Centre reserves the right to refuse an application for any good reason.

2.2 Your Card is issued by, and remains the property of Kings Heath Pet Centre . It must be returned to Kings Heath Pet Centre on request or destroyed when no longer valid for use. Your Card is not and must not be used as a credit card, guarantee card or as any other form of security against sums you might owe to third parties.

2.3 Un-registered Cards will not be eligible for Kings Heath Pet Centre Loyalty Card benefits.

2.4 If you breach these Conditions, or if Kings Heath Pet Centre reasonably believes that you have breached these Conditions and/or abused , Cards may be terminated without prior notice. Kings Heath Pet Centre reserves the right to take any action deemed necessary where a Card is found to have been used in a way that abuses Kings Heath Pet Centre.

2.5 In addition to section 2.4 above, the Kings Heath Pet Centre also reserves the right to: (a) stop issuing Cards at any time; (b) on notice to you, alter or amend these Conditions of operation of the Card; and (c) on notice to you, withdraw or cancel the Cards.

2.6 You may terminate your Card at any time by emailing us at enquiries@kingsheathpetsupplies.com

2.7 You are responsible for the security of your Card. If you believe an unauthorised person has compromised the security of the Card by, for example, its theft or the theft of personal or password information relating to it you should notify Kings Heath Pet Centre immediately. Lost, damaged or stolen Cards can be replaced by the till staff at our Store. Kings Heath Pet Centre will not be responsible for any unauthorised use of the Card or any lost or stolen vouchers.

2.8 Any Card issued is personal to the person whose personal details were submitted with their registration. A Card and any points on it are non-transferable, and can only be used by the registered cardholder.

3. Kings Heath Pet Centre Loyalty Card Vouchers & Points

3.1 Kings Heath Pet Centre Loyalty Card vouchers are personal to you, non-transferable and cannot be exchanged for cash. They can only be used when presented with the registered Card. Vouchers that Kings Heath Pet Centre deem to be damaged, defaced or photocopied will not be accepted.

3.2 General Terms

(a) Kings Heath Pet Centre may vary these Conditions and will give Loyalty Card members as much notice as it reasonably can. Such variations will be published on www.kingsheathpetcentre.co.uk. Using vouchers following such variation shall constitute acceptance of the changes that Kings Heath Pet Centre makes.

(b) (b) If Kings Heath Pet Centre decides to transfer the scheme to another legal entity it may transfer all of its rights and obligations under these Conditions without your consent and may disclose information about you to any potential or new owner.

(c) (c) Kings Heath Pet Centre will only be liable to Card members for losses that members suffer from Kings Heath Pet Centre breaches of these Conditions. This limit on liability does not exclude or limit the Club’s liability for death or personal injury caused to a Cardholder as a result of Kings Heath Pet Centres negligence. These Conditions prevail if they conflict with any other material issued by Kings Heath Pet Centre to Loyalty Cardholders in connection with the operation of the loyalty scheme.

(d) (d) Kings Heath Pet Centre and Cardholders rights and obligations under these Conditions and any dispute in relation to them shall be governed by English law and heard to the exclusion of all other forums in the English courts. Kings Heath Pet Centre obligations to Cardholders in respect of Kings Heath Pet Centre Loyalty Card are contained in these Conditions and nowhere else.

3.3 To collect points in store, you must present your Kings Heath Pet Centre Loyalty Card at the till at the time of purchase.

3.4 Points will be awarded on all merchandise sold in our store, with the exception of gift cards and vouchers, home delivery, Discount events are held throughout the year and these are excluded from any discount offered to Kings Heath Pet Centre Loyalty Card members.

3.5 Where points have been awarded and a subsequent refund has been given, any points allocated to the product purchased and refunded will be deducted from the card total.

3.6 Points will not be awarded for any online purchases.

4. Data Protection

4.1 This section sets out how Kings Heath Pet Centre Loyalty Card collects your personal data, how Kings Heath Pet Centre uses it and who Kings Heath Pet Centre shares it with. Under the Data Protection Act 1998 (the “Act”), your data controller is the legal entity that operates Kings Heath Pet Centre.

4.2 Use of your personal data (a) By joining up to Kings Heath Pet Centre Loyalty Card and providing your personal data you agree to your name, age, date of birth, postal address, email address and other personal data you supply (‘personal data’) being used by operators of Kings Heath Pet Centre and their website. (b) Loyalty scheme members also agree to their personal data being used by Kings Heath Pet Centre to send the following by e-mail and/or by post:

(i) Kings Heath Pet Centre mailings and notification of any programme changes.

(ii) Marketing and promotional materials about goods and/or services on offer at Kings Heath Pet Centre.

4.3 Retention: We will hold your personal data on our systems for as long as is necessary to administer your membership with Kings Heath Pet Centre Loyalty Card . If you cancel your registration as a member or you haven’t used your Kings Heath Pet Centre Loyalty Card for longer than 24 months we will remove your personal details from our database.

4.4 Security: Your personal data shall only ever be held and stored on secure computer servers. Kings Heath Pet Centre confirms that it has in place adequate safety and security measures to keep your personal information safe and secure in accordance with its obligations under the Act.

4.5 Access to Personal Data: The Act gives you the right to access information held about you by Kings Heath Pet Centre Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.
